TERMS & CONDITIONS

1. GENERAL

1.1

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as "you") with Third Diary Ltd ("Third Diary", "us" or "we"), at the Third Diary website or mobile website (jointly referred to as "3rddiary.com").

1.2

By using 3rddiary.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the "Terms"). Please read these Terms and Conditions carefully before placing any orders on 3rddiary.com.

1.3

In order to shop on 3rddiary.com, you must be at least 18 years old and not under guardianship.

1.4

The Third Diary website only offers products that we have in stock and that are published on 3rddiary.com. The inclusion of these products does not mean that they will be available at any time. We reserve the right to discontinue any product at any time.

1.5

We may modify these Terms and Conditions from time to time. The version applicable to your order will be the version published on 3rddiary.com at the time your order is placed.

2. PRICES AND DELIVERY CHARGES

2.1

The prices displayed on 3rddiary.com include statutory Value Added Tax (VAT) for UK orders only and do not include delivery charges. International orders may be subject to import duties, customs fees, local taxes and VAT charges once the goods arrive in the destination country. These charges are the responsibility of the customer.

3. ORDERING / CONCLUSION OF CONTRACT

3.1

Once you have placed your order, you will receive an email confirmation if you have provided a valid email address. If for any reason we are unable to fulfil your order, we will notify you as soon as possible. If payment has already been received, we will refund the applicable amount using the original payment method.

4. DELIVERY

4.1

Third Diary will take the greatest care to ensure orders are dispatched accurately and promptly. We deliver to residential and business addresses. We do not ship to P.O. Box addresses.

4.2

Orders are normally delivered within 2–7 working days (Monday–Friday) from the date of dispatch. Delivery times may vary depending on destination and circumstances beyond our control.

4.3

Shipping fees and estimated delivery times will be displayed at checkout.

4.4

If your order has not arrived within the expected timeframe, please contact us at studio@3rddiary.com.

5. WITHDRAWAL OF ORDER

5.1

You have the right to cancel or return your purchases within 7 calendar days after the day of delivery of the goods. You may return the goods provided they meet the conditions outlined in these Terms. Return shipping costs are the responsibility of the customer.

5.2

If you wish to cancel or return your order, you must notify us by email within the 7 day period outlined in section 5.1.

5.3

Refunds will be issued using the original payment method within 14 days of receiving and inspecting the returned goods.

5.4

Any items returned after the 7 day return period will not be eligible for a refund. At our discretion, a store credit may be offered provided the item is received within 14 days of delivery.

5.5

No refunds or store credits will be issued for items received after 14 days from the delivery date.

5.6

Sale items are non-refundable. Where a sale item is eligible for return, a store credit may be offered at our discretion. Any restrictions relating to sale items will be clearly stated on the product page at the time of purchase.

5.7

If the item you receive is faulty, please notify us as soon as possible. Faulty items will be inspected upon return and, where confirmed, a full refund including original delivery charges will be issued.

6. RETURNS

6.1

All returned items must be unworn, unused, unwashed and returned in their original condition with all tags and packaging intact.

6.2

Items showing signs of wear, washing, alteration, damage or misuse may not be eligible for a refund.

6.3

The customer remains responsible for returned items until they have been received by Third Diary. We recommend obtaining proof of postage and retaining tracking information.

7. PAYMENT METHODS

7.1

Credit and Debit Cards

We accept major credit and debit cards including Visa, Mastercard and American Express. Payment may be authorised at the time of purchase.

7.2

PayPal

Payments can be made through PayPal. By using PayPal, you agree to PayPal's own terms and conditions.

7.3

Third Diary does not accept cash or cheques.

8. OUR LIABILITY

8.1

Nothing in these Terms shall exclude or limit liability where it would be unlawful to do so.

8.2

Third Diary shall not be liable for indirect losses, loss of profits, loss of opportunity or delays caused by circumstances beyond our reasonable control.

8.3

Our maximum liability arising from any order shall not exceed the total value of that order.

9. PRODUCT IMAGES AND COLOURS

9.1

We make every effort to display product colours and details as accurately as possible. However, colours may vary depending on device screens and display settings.

10. GUARANTEE

10.1

If goods supplied by Third Diary are faulty or defective, we will comply with all applicable consumer protection legislation.

11. OWNERSHIP OF RIGHTS

11.1

All intellectual property rights including trademarks, logos, product imagery, website content and designs remain the property of Third Diary Ltd.

11.2

Any use, reproduction or distribution of content from 3rddiary.com without prior written consent is prohibited.

12. DATA PROTECTION

12.1

Third Diary Ltd processes personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

12.2

We will not sell, distribute or lease your personal information to third parties unless required by law or necessary to fulfil your order.

13. COUNTRY OF ESTABLISHMENT

13.1

The United Kingdom is our country of permanent establishment.
